Livon Major Advertiser Program Fees and Policies

These fees and policies are incorporated into and are made a part of the  Livon Advertiser Terms and Conditions.

Under the Major Advertiser Program, there is no charge for you to advertise for new residents (“Residents”) for your Senior Housing Facility on the Website but your advertising is subject to Fees as provided below.

Fees For Reported Residents. You will pay to us  the specified advertising fee for each “Reported Resident,” which means a situation where a Resident (a) finds your Senior Housing Facility advertised on the Livon section of website/pages (the “Website”) and/or on the iAccess Senior Living Services website/pages (the “iAccess Senior Living Services Website”); (b) becomes a Resident of your Senior Housing Facility; (c) the residency is reported to Livon or otherwise comes to the attention of Livon.

On the Website, Livon directs potential residents and those with legal authority to act for them to tell the Senior Housing Facility they found them on Livon or iAccess Senior Living Website and encourages them to write “Livon” or “iAccess Senior Living”  as their source on guest cards and/or applications. In addition, you agree to notify us  within 10 days of each Resident you find through us.  However even if Livon or iAccess Senior Living is not noted as the source by the Resident or notified by you, you will remain liable for the Fee if there is other reasonable evidence that the Resident or those with legal authority acting for the Resident found the property on Livon (e.g. emails on the Livon website) or iAccess Senior Living Services Website.  As permitted by law, there can be a financial benefit (“Reward”) or other incentive paid by Livon to the Resident or to those with legal authority to act for the Resident for reporting the Residency and you consent to the Rewards Program. These additional terms governing the Rewards Program are set forth on the Rewards Program page of the Website.

You will be obligated to pay to us a success fee, which equals Six-Hundred and Fifty Dollars ($650.00) per Reported Resident, unless otherwise agreed (the “Fee”). In the event your Senior Housing Facility changes its manager or is sold, you will remain liable for all Fees attributable to Reported Residents after such management change or sale. In the event your access to the Website is terminated or discontinued for any reason, you will remain liable for all Fees attributable to Reported Residents for thirty (30) days after the effective date of such termination. In the event that one advertisement results in more than one Reported Residency , there will be a Fee for each Reported Residency.

Billing.  When setting up your account with us, you will designate an address for billing.  You must pay the Fee for each Resident within ten (10) days after the date which you are invoiced, If you believe there is an error on the invoice, please notify us within the 10-day period; if you fail to notify us within such 10-day period, the invoice will be deemed accurate and valid.  Any Fees not paid when due will accrue interest at a rate of 1.5% per month or the highest rate allowed by applicable law, whichever is lower. In addition, failure to pay on time may result in deactivation of your account, removal of any privileges, Postings or other action. You will incur additional Fees for so long as your Senior Housing Facility advertisement is active on the Website.

Change of Facility Management/Termination by You. In the event of a change of management of your Senior Housing facility(ies) (without a change of ownership of your Facility(ies) prior to the expiration of the Claims Period, you will remain liable for all Fees attributable to your Posting.  Further, in the event your Posting is terminated by you prior to the Posting Period, you will remain liable for all Fees attributable to your Posting and no refunds will be given.

Potential Residents. There is no charge for a potential Resident or those who are legally authorized to act on the potential Resident’s behalf to search for Senior Housing Facilities; however, these persons must create a free registration account.

General. Subject to applicable law, Livon reserves the right to change these fees at any time effective when posted on the Website. Livon may choose to temporarily change this Fee Schedule for promotional events, and such changes are effective when Livon posts the temporary promotional event on the site. Livon maintains sole discretionary right to change some or all of its services at any time. In the event that Livon introduces a new service, the fees for that service are effective at the launch of the service. Unless otherwise stated, all fees are quoted in U.S. dollars. Users are responsible for paying all fees associated with using the Livon service and with using Livon’s website, and for all applicable taxes.
